The agreement

These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the https://authenticateme.xyz/ website ("Website"), the AuthenticateMe Discord application ("App"), and any of their related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you" or "your") and this Website operator ("Operator", "we", "us" or "our").

By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services. You acknowledge that this Agreement is a contract between you and the Operator, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

Age requirement

You must be at least 13 years of age to use the Website and Services. By using the Website and Services and agreeing to this Agreement, you represent that you are at least 13 years of age. You must also meet the minimum age required by Discord's own Terms of Service in your country.

The services

AuthenticateMe provides verification and security services for Discord servers. The staff of each server chooses which available checks and moderation actions to enable. AuthenticateMe evaluates the applicable account, session, and security information according to those settings and its verification logic. A kick, ban, role change, or other configured action is then performed by the App on the server's behalf. If you believe a verification outcome is incorrect, contact the staff of the server in question.

You acknowledge that verification systems are not infallible and that we make no guarantee that the Services will detect or prevent every alternative account, automated account, or bad actor, nor that legitimate users will never be flagged.

Your data

Our collection, use, and disclosure of personal information in connection with the Services is described in our Privacy Policy, Cookies Policy, and Data Collection page. Participating server staff may receive verification outcomes, detection labels, relevant linked Discord-account references, and configured moderation actions, but they do not receive the underlying raw IP address, identifier cookie, stored fingerprint, or email address.

Verification records and deletion

AuthenticateMe verification status is based on an existing verification record. If that record is deleted following a deletion request, we can no longer confirm or support the previous verification, and access that depended on it may be withdrawn. As an operational consequence, you may be removed only from servers where you previously completed AuthenticateMe verification successfully, not from servers where you did not successfully verify.

Requesting deletion is not misconduct and does not by itself result in a permanent AuthenticateMe ban. Individual Discord servers control their own membership and moderation decisions, and you may join or verify again unless an individual server independently prevents it. The process and any limited retention permitted or required by applicable law are explained in our Privacy Policy and Data Deletion page.

Links to other resources

Although the Website and Services may link to other resources, we do not imply approval, association, sponsorship, endorsement, or affiliation unless we specifically say otherwise. We are not responsible for examining or evaluating external offerings or content, and we do not assume responsibility for third-party actions, products, services, or content. Review the legal terms and policies of any external resource you access. If you follow an external link, you do so at your own risk.

Premium & payments

Some features of the Services are available through paid Premium subscriptions. Premium subscriptions are currently purchased through Patreon, which processes payments under its own terms and privacy policy. Premium features are provided while the applicable subscription remains active. Refunds are subject to the payment provider's terms and any rights you have under applicable law. We may change Premium tiers, pricing, or included features, with pricing changes applying no earlier than the next billing period unless applicable law requires otherwise.

Acceptable use

Intellectual property

Except for third-party components and content owned by others, the Website, the App, the Services, and the code, design, branding, name, and content we create are our property and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, resell, or create derivative works from our protected materials without our prior written permission. This includes operating a clone or imitation of our Website or Discord App.

Prohibited uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website and Services or their content:

• for any unlawful purpose;
• to solicit others to perform or participate in any unlawful acts;
• to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
• to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
• to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
• to submit false or misleading information;
• to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website and Services, third-party products and services, or the Internet;
• to spam, phish, pharm, pretext, spider, crawl, or scrape;
• to attempt to bypass, deceive, or interfere with any verification check, including through the use of alternative accounts, VPNs or proxies where blocked, spoofed devices or browsers, or automation;
• for any obscene or immoral purpose; or
• to interfere with or circumvent the security features of the Website and Services, third-party products and services, or the Internet.

Termination

To the extent permitted by applicable law, we may suspend or terminate your access for a material violation of this Agreement or where we reasonably believe your use poses a security, legal, or safety risk to us, other users, or participating Discord servers. We may act immediately where necessary to address that risk; otherwise, we will provide reasonable notice where practicable.

Making a deletion request or exercising a privacy right is not a violation of this Agreement and does not, by itself, provide a reason to suspend or terminate your access.

Liability

Disclaimer of warranty

The Website and Services are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. You use the Website and Services at your own risk.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will the Operator, its affiliates, or their respective officers, employees, agents, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, revenue, data, use, or goodwill, arising out of or in connection with your use of, or inability to use, the Website and Services, even if we have been advised of the possibility of such damages. To the fullest extent permitted by applicable law, our aggregate liability for all claims relating to the Website and Services shall not exceed the greater of the amount you paid us for the Services in the twelve months preceding the claim or ten euros (€10). Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify the Operator against third-party claims, losses, liabilities, and reasonable costs resulting from your unlawful use of the Services, your material breach of this Agreement, or your infringement of another person's rights. This obligation does not apply to the extent a claim was caused by the Operator's own breach, negligence, or willful misconduct, and it does not limit rights or liabilities that cannot lawfully be limited.

General

Severability

If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of this Agreement shall remain in full force and effect.

Changes and amendments

We may update this Agreement to reflect changes to the Services, our practices, or applicable requirements. We will revise the updated date at the top of this page and provide any additional notice or request any consent required by applicable law. Changes take effect when posted unless a later date is stated. To the extent permitted by law, continuing to use the Services after the effective date means you accept the updated Agreement.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.
